Acceptance of Terms

By accessing, purchasing, downloading, or using any products or services provided through this website, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please discontinue use of this website and its services.

Introduction

These Terms and Conditions govern the use of digital products and services provided by AFM in California. By purchasing or using our products, you acknowledge that you have read, understood, and agreed to these Terms.

Digital Products

AFM sells exclusively digital products, including pre-made imagery packs, custom imagery, horizontal imagery, vertical imagery, and 10-second video clips. All products are delivered digitally.

  • Pre-made products: Instant digital download after purchase
  • Custom projects: Delivered after project completion through AFM’s project workflow

License & Usage

When you purchase digital products from AFM, you are granted a non-exclusive, non-transferable license to use the assets for personal and commercial purposes, including:

  • • Websites
  • • Social media content
  • • Advertising campaigns
  • • Marketing projects
  • • Client work

You may edit or modify the assets for your campaigns.

Restrictions

You may not:

  • Resell or redistribute raw files
  • Repackage assets into competing asset collections
  • Upload assets to stock or marketplace platforms
  • Transfer licenses to third parties
  • Claim ownership of original source assets
  • Use assets in unlawful, deceptive, defamatory, or harmful content

Exclusivity

  • • Pre-made products are available for purchase by multiple customers
  • • Custom projects are non-exclusive by default. Exclusive usage rights or ownership transfers must be agreed upon separately in writing and may require additional licensing or project fees.

Payments & Refunds

  • • Pre-made digital products are non-refundable
  • • Custom projects are non-refundable
  • • Fraudulent disputes, chargebacks, or unauthorized payment reversals may result in revoked access to purchased assets and termination of licensing rights.

Custom Projects

  • Projects under $2,500 require full payment before work begins.
  • Projects of $2,500 or more require a 50% upfront deposit and remaining balance prior to final delivery.
  • Deposits are non-refundable once project work has started.
  • Two rounds of revisions are included unless otherwise agreed in writing.
  • Additional revisions or scope changes may require additional fees.
  • Project timelines are estimates unless guaranteed in writing.

Commercial usage rights for custom projects are granted after final payment has been received in full.

Custom projects are non-exclusive by default. Exclusive usage rights or ownership transfers must be agreed upon separately in writing and may require additional licensing or project fees.

Intellectual Property

All digital products, including AI-generated imagery and video clips, remain the exclusive copyright of AFM. Customers receive a license to use the assets under the terms outlined above.

Limitation of Liability

AFM is not liable for any indirect, incidental, or consequential damages arising from the use of our digital products. AFM does not guarantee marketing performance or results.

Age Restrictions

Purchasers must be at least 18 years old or have parental consent to use AFM’s digital products.

Account Requirements

Accounts are required for custom project management. The platform used to manage customer accounts will be disclosed only in the Privacy Policy.

Content Restrictions

Customers may not use AFM products for:

  • • Illegal activities
  • • Pornography or adult content
  • • Hate speech, discrimination, or defamatory content
  • • Redistribution or resale of the files

Updates to Terms

AFM reserves the right to update or modify these Terms at any time. Changes will apply to all existing and future products.

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
